Terms of Service

These Terms of Service ("Terms") govern your use of services, software, biometric technology, and products (the "Services") provided by Trst Innovations Inc. ("Trst").

By accessing or using the Services, or by clicking to accept or agree to the Terms when this option is made available to you, you agree to be bound by these Terms and all terms incorporated by reference. If you do not agree to these Terms, do not access or use the Services.

1. Services Description

Trst provides a biometric payment platform that allows users to make payments using palm vein recognition technology. The Services include:

  • User registration and identity verification
  • Biometric enrollment and authentication
  • Payment processing and transaction history
  • Mobile application access
  • Customer support

2. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you must have your parent or legal guardian's permission to use the Services, and they must agree to these Terms on your behalf.

By using the Services, you represent and warrant that:

  • You are at least 13 years old
  • If you are under 18, you have obtained parental or guardian consent
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations
  • You have not been previously suspended or removed from using the Services

3. User Accounts

To use the Services, you must create an account and complete our identity verification process. You must provide accurate, current, and complete information during the registration process and keep your account information updated.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying Trst immediately of any unauthorized use of your account or other security breaches

Trst will not be liable for any loss or damage arising from your failure to protect your account credentials or comply with these requirements.

4. Biometric Information

The Services use palm vein recognition technology, which captures biometric information. By using the Services, you consent to:

  • The collection, use, and storage of your biometric information
  • The processing of this information for the purposes of authentication and fraud prevention
  • The retention of this information in accordance with our Privacy Policy

You have the right to withdraw your consent at any time by closing your account. However, this will result in termination of your access to the Services.

5. Payment Terms

You authorize Trst and its third-party payment processors to store your payment information and to process payments for transactions you initiate through the Services.

You agree to:

  • Provide valid payment information
  • Pay all amounts owed on time
  • Maintain sufficient funds in your payment accounts

All payments are non-refundable except as expressly provided in these Terms or as required by applicable law. For our refund policy, please see our Refund Policy.

6. Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Services or other users' accounts
  • Interfere with or disrupt the integrity or performance of the Services
  • Attempt to decompile, reverse engineer, or disassemble the software
  • Use the Services to process fraudulent transactions
  • Harvest or collect information about other users without their consent
  • Use another person's biometric information or impersonate another person

Violations of these prohibitions may result in termination of your account and potential legal action.

7. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to software, text, images, logos, and designs) are owned by Trst, its licensors, or other providers and are protected by copyright, trademark, patent, and other intellectual property laws.

These Terms do not grant you any rights to use Trst's trademarks, logos, domain names, or other brand features.

8. Termination

Trst may terminate or suspend your account and access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by following the instructions in the Services or by contacting customer support.

Upon termination:

  • Your right to access and use the Services will immediately cease
  • We will retain your information in accordance with our Privacy Policy
  • All provisions of these Terms which by their nature should survive termination shall survive

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRST DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TRST DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRST, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL TRST'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Trst, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

12. Governing Law and Dispute Resolution

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the courts of Ontario, although Trst retains the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

13. Changes to Terms

Trst reserves the right to modify or replace these Terms at any time at its sole discretion. If a revision is material, Trst will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Trst's sole discretion.

By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
